Information To Download For Your Free (Up to One (1) Hour) Initial Probate or Trust Settlement Consultation and to Bring to our First Meeting
By Michael J. Howell
We use the Short Checklist below during our initial meeting to determine if (1) the decedent's Personal Representative or Trustee needs to file an estate tax return, (2) there are assets which require the appointment of a Personal Representative, (3) more simplified procedures can be used and (4) to spot numerous other potential issues.
If the Short Checklist indicates that either the appointment of a Personal Representative or the filing of an estate tax return is required, then we normally have a longer second conference to review the Long Checklist. With the Long Checklist, we review the duties and responsibilities of Personal Representative(s) and Trustee(s). During the meeting, we explain the probate and/or trust settlement procedures and assign duties and responsibilities between the Personal Representative(s), Trustee(s), CPA, our office, and others, as needed.
The Representation/Engagement Letter sets forth the agreement between our law firm and the Personal Representative(s) and/or Trustee(s), the scope of our engagement, our fees and the estimated costs.
Download the Short Checklist and the Representation/Engagement Letter. Then call our office to schedule a mutually convenient time to meet. For the free initial one hour consultation, you also need to bring with you substantially all of the information from the Short Checklist that applies. Some of the information will not apply in all cases.
As part of the scheduling of our workflow, appointments are normally scheduled for 2:00 p.m. or 4:00 p.m. on Tuesdays, Wednesdays and Thursdays. Mornings on these days, and Mondays and Fridays, are the times that we work on our cases and both our staff and our attorneys need to be available; otherwise, the work flow is significantly disrupted. These are our “workflow” times.
For meetings conducted during the normal non-workflow times, there is a $50 credit given on the bill, assuming it is not a free initial consultation for new clients, as outlined in our engagement/representation letter. For meetings scheduled during our workflow periods, there is an extra charge of $100 for the conference, in addition to other charges.
Free initial consultations, as defined on our website and client packages, are only scheduled during our normal appointment times and not our workflow times. An initial consultation can be scheduled during our workflow times, but we charge our normal hourly rates, plus the additional charge of $100 for the conference.
